Terms of Service

The agreement between AMAH and the people and organizations that use the marketing site and the platform.

1. Acceptance

By accessing the AMAH marketing site or platform, you agree to these Terms of Service. If you are using AMAH on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The service

AMAH is a hosted Electronic Health Record platform designed for medical aesthetics practices. Specific features, capacity, and support levels are determined by your subscription tier or written agreement.

3. Acceptable use

You will not (a) circumvent security controls, (b) attempt to access another customer's data, (c) use the service to violate applicable law, or (d) interfere with the integrity or performance of the service.

You are responsible for the activity of users you authorize on your AMAH account, including the accuracy and lawfulness of data you upload.

4. Customer data

You retain all rights to data you submit to the platform. We process Customer Data on your behalf as a service provider and, where applicable, as a business associate under HIPAA pursuant to a separate BAA.

You grant AMAH a limited license to host, process, and transmit Customer Data solely to provide the service.

5. Fees

Subscription fees are described in your order form or, for online sign-ups, in your account settings. Fees are non-refundable except where required by law or expressly stated in writing.

6. Term and termination

Your subscription continues until terminated as described in your order form. We may suspend or terminate access for material breach of these terms with reasonable notice and an opportunity to cure where applicable.

On termination, you may export Customer Data for a defined window before deletion.

7. Warranties and disclaimers

We provide the service with reasonable skill and care. Except as expressly stated, the service is provided "as is" and AMAH disclaims all other warranties, including implied warranties of merchantability and fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages. Total liability arising from the service is capped at the fees paid in the prior twelve (12) months, except where prohibited.

9. Governing law

These terms are governed by the laws of [jurisdiction TBD], without regard to its conflict-of-laws principles.

10. Changes

We may update these terms from time to time. Material changes will be highlighted on the marketing site and, where appropriate, by direct notification.
